Mr. Lanier continues his criticism of the way the Internet is evolving, in his Wall Street Journal article, and feels the Internet has gone off-course. He, again, uses the term “de-humanizing” and further states that the surplus of voices on the “web” makes everything flat and, at times, scary. He asks the rhetorical question: “What if all the voices wind up drowning out one another?” He further states that the Internet is robbing people of their dignity and is encouraging “design by committee”, therefore stifling originality, what he calls “digital collectivism”. Mr. Lanier also points out that only a handful of writers and musicians are making a living on the “web”.

In the cbc interview, Jarod Lanier, the author of “You are not a gadget”, discusses several ways in which the Internet is evolving that he finds disturbing. One is that software itself is “anti-human”, contradictory to the original design and hope for the Internet. He also feels that new systems are being designed for the computer to do well, and not as much for people to do well, anymore. This is at a time where the Internet is expanding and the world economy is shrinking. Some examples are the MIDI music system, which at times, not only doesn’t sound natural, but, is making some musicians expendable; Facebook which, in his opinion, at times, encourages “mob mentality”; wiki, which exudes dull and boring content and a variety of sites and programs that are making things “meaningless amd mean”. He states that many of the above examples are “de-humanizing” and, unfortunately, trend toward encouraging “anonimity.

I read Jakob Neilsen’s article re: the “F” pattern that people unconsciously follow when reading information fron a web-site. I think he’s right on the money, and I also seem to follow the same pattern. The 2 web-sites I picked were MSN.com, Microsoft’s newly revised home page, as an example of a very interesting site and Jacob Nielsen’s Alert Box, as a site I probably would have either skipped or given up on shortly into it, that is if I didn’t have it as a class assignment. (Although, it was a great article.) I think MSN’s site is colorful and eye-catching, with a minimum of movement, yet catches the eye in that the graphics change approx. every 30 seconds and it keeps the viewer interested. There are plenty of choices and links available so it appears that one can spend hours on this site alone and not be bored. Mr. Nielsen’s web-site looks and reads like a newspaper article, and generates little excitement in the reader. Of course, these are two completely unrelated sites, but one is dull and business-like and the other is graphically stimulating; busy, but not dizzy in its presentation.

Fair Use can be loosely defined as exceptions to the restrictions of copyright laws, that is, what exactly can be used WITHOUT the permission of the creator of the copyrighted artistic work. The laws re: Fair Use were designed to be rather flexible and court cases have shown that most disputes re: Fair Use litigation is handled by the courts on a case-by-case basis.

The 4 principles of Fair Use:

1. What has been done with the copyrighted material? (Was it used to make a profit?… was it transformative?)

2. Where was it borrowed from? For example, borrowing from historical texts, is considered proper use of these laws.

3. What was the amount of copyrighted material used? This question is dependent on HOW the material was used, as well.

4. What was the effect on the market as a consequence of the use of the copyrighted material? (Was there usurping of the value of the material? Would the general public want to purchase the “new” product, rather than the original?

All of the above principles are non-exclusive, in that they are mutually dependent on each other in making a determination re: proper use of copyright law.

Fair Use: doctrine in copyright law that allows limited use of copyrighted material without requesting permission from the rights holders. Examples would be: news reporting, commentary, reviews, critics, etc..

See previous blog post for ” copyright” definition. Copyrights, in theory, build upon the values of the 1st amendment in that it secures for a limited time to authors, inventors, artists etc. the exclusive right to their writings, discoveries and works of art. Fair Use, as best as I can ascertain, is, although someone holds a copyright on a “creation”, certain laws apply to allow use of that creation by individuals, with the permission of the creator. And of course, copyrights exist for a limited amount of time, hence, public domain. “Production of new knowledge and cultural experience” ARE important to society in that they allow and promote the sharing of new ideas (ex. science and arts), yet simultaneously allow authors, artists, and composers to benefit from their intellectual properties.
